Version 0.1 (draft) — 7 September 2026
These terms are a contract between you and the operator of the SIAMGO service. Please read them before booking. They apply to the website siamgo.app, the SIAMGO iOS app, and any booking you make through them — whether or not you create an account.
SIAMGO is operated by:
Contact for questions and complaints: [support email — confirm mailbox, e.g. support@siamgo.app].
2.1. SIAMGO is a booking service. We act as a booking agent of independent tour operators and service partners ("Operators") who provide the tours, transfers, border-run trips, eSIM and other services listed on SIAMGO ("Services").
2.2. When you book, your contract for the performance of the Service is with the Operator. The Operator — not SIAMGO — conducts the tour or provides the Service and is responsible for its performance, safety, insurance and the licences it needs. The Operator for your booking is identified in your booking confirmation. [Thai counsel: confirm the agency framing holds given that SIAMGO is the customer-facing brand and may collect the full price; see also Tourism Business and Guide Act B.E. 2551 (2008) licensing posture.]
2.3. SIAMGO is responsible to you for:
2.4. Descriptions, photos, prices and schedules are provided to us by Operators. We check them in good faith but the Operator is responsible for their accuracy on the day of service.
3.1. You must be at least 20 years old to book (the age of majority under Thai law). By booking you confirm this. You may book for other people, including minors travelling with you, if you have their permission and you give us accurate details about them.
3.2. You can book with or without an account ("guest checkout"). Either way, these terms apply to your booking.
3.3. You must give accurate contact details. If we or the Operator cannot reach you (wrong phone, wrong pickup address), we may not be able to provide the Service and this may count as a no-show under the cancellation rules of your booking.
4.1. A booking request becomes a confirmed booking when we send you a booking confirmation by email or in the app. Availability is not guaranteed until then.
4.2. If payment (or the required deposit) is not received within the payment window shown at checkout, the booking request lapses.
4.3. Some payments are verified manually. "Paid" status may take a short time to appear; your booking is held in the meantime. If you paid and see no confirmation within a reasonable time, contact support and we will resolve it.
4.4. Your booking confirmation (voucher) states the Operator, meeting point or pickup details, and what is included. Check it on receipt and tell us immediately if anything is wrong.
5.1. Prices are shown as total prices in Thai Baht (THB), including applicable taxes and mandatory fees, unless the listing clearly states an extra payable on site (for example a national-park entrance fee). Prices displayed in other currencies (for example roubles) are indicative conversions at a current exchange rate; the amount you owe is the listed amount.
5.2. Payment for a booking works in one of two ways, as stated at checkout for that Service:
the balance of the price directly to the Operator — for example in cash on the day of service. The checkout page and your voucher state the exact split. The balance you pay the Operator is a payment to the Operator, not to us.
Operator's behalf as its agent**; your payment to us discharges your payment obligation to the Operator. [Thai counsel: Payment Systems Act B.E. 2560 (2017) "receiving payment on behalf" analysis for model (b) before it goes live; confirm agent-of-payee wording.]
5.3. We do not store card data. Payment methods available are shown at checkout.
5.4. If a price shown was an obvious error, we may cancel the booking before the service date and refund everything you paid to SIAMGO for it.
6.1. Your cancellation. Each listing shows its cancellation cutoff (for example, "free cancellation until 24 hours before start"). If you cancel before the cutoff, we refund what you paid to SIAMGO for that booking in full. If you cancel after the cutoff or do not show up, the amounts you paid to SIAMGO may be retained as stated on the listing, and any balance payable to the Operator is governed by the Operator's terms.
6.2. Statutory 7-day right. Under the Direct Sales and Direct Marketing Act B.E. 2545 (2002), consumers buying at a distance may have the right to cancel within 7 days of purchase. Where this right applies to your booking, it is not limited by clause 6.1. [Thai counsel: application of the 7-day rescission right to date-specific tour bookings, and whether services already performed within the 7 days are excluded.]
6.3. Cancellation by the Operator or by us; weather. If the Operator cancels (including for weather or safety reasons), or we cancel, you choose: a full refund of everything you paid to SIAMGO for the booking, or — where offered — an alternative date or Service. If you already paid a balance directly to the Operator, the Operator must refund that balance; we will help you pursue it.
6.4. Changes by the Operator. If the Operator materially changes a confirmed booking (time, itinerary, boat/vehicle class) and the change is not acceptable to you, you may cancel with a full refund of what you paid to SIAMGO.
6.5. How refunds are paid. Refunds of amounts paid to SIAMGO are made to the payment method you used (or, where that is impossible, by an alternative method agreed with you) within 7 business days of our confirming the refund. Currency-conversion differences and third-party transfer fees outside our control are not our responsibility.
6.6. Vouchers and promo codes are refunded as vouchers/promo value unless the law requires otherwise.
7.1. Border-run and visa-related trips involve crossing an international border. Entry into Thailand (or any country) is decided solely by immigration officers. Neither SIAMGO nor the Operator guarantees entry, a stamp, a visa, or a particular period of stay. Rules change frequently (for example, limits on the number of visa-exempt land-border entries per year); you are responsible for checking that a border run is suitable for your passport and entry history.
7.2. If you are refused entry or exit, the Service is treated as performed to the extent it was provided. We will refund the amounts you paid to SIAMGO minus documented costs already incurred for your trip (for example transport seat, agent and border fees actually paid out). We will show you the documentation for any deduction.
7.3. You are responsible for carrying a valid passport and any documents required for the crossing, and for complying with instructions of the Operator's staff and officials.
7.4. For airport transfers, you must provide an accurate flight number; the Operator monitors reasonable delays as described in the listing. A missed transfer caused by incorrect details you gave is treated as a no-show.
8.1. Follow the Operator's safety instructions, arrive on time at the meeting point, and do not participate in activities (swimming, snorkelling, motorbike use) beyond your health and abilities. Tell the Operator about relevant medical conditions before the activity where the listing asks for it.
8.2. The Operator may refuse or stop the Service, without refund of the Operator's balance, for behaviour that endangers others, intoxication, or breaking the law. Any refund of SIAMGO-collected amounts in such cases is at our reasonable discretion.
9.1. You may post reviews, ratings and photos only about experiences you actually had. No unlawful, defamatory, obscene or infringing content; no personal data of third parties without their consent.
9.2. You keep ownership of your content. You grant SIAMGO a non-exclusive, worldwide, royalty-free licence to host, display, translate and reasonably edit (formatting, excerpts) your reviews and photos on SIAMGO surfaces and in SIAMGO's own marketing of the listing concerned. You can ask us to take a review down at any time.
9.3. We moderate reviews before publication and may remove content that breaks these rules or the law. To report illegal or infringing content, contact [support email]; we act on substantiated complaints promptly. [Thai counsel: notice-and-takedown wording sufficient for the Computer Crime Act B.E. 2550/2560 s. 15 safe-harbour posture.]
10.1. The Operator is liable for the performance of the Service itself — including the conduct of the tour, transport and equipment safety, staff, insurance cover, and holding the licences required for its business.
10.2. SIAMGO is liable for the matters in clause 2.3 — the booking process, the handling of money we collect, support, and passing on information — where we fail to perform them with reasonable care.
10.3. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, or for wilful misconduct or gross negligence, or any liability that cannot be excluded under Thai law (including the Unfair Contract Terms Act B.E. 2540 (1997) and Civil and Commercial Code s. 373).
10.4. Subject to 10.3, SIAMGO's total liability for a booking is capped at the amounts you paid to SIAMGO for that booking, and we are not liable for indirect losses (lost flights booked separately, lost earnings) that we could not reasonably foresee.
10.5. Neither we nor the Operator are liable for failure caused by events beyond reasonable control (storms, floods, epidemics, government orders, border closures) — but your refund rights under clause 6.3 still apply to SIAMGO-collected amounts.
How we handle your personal data is described in the SIAMGO Privacy Policy (a separate document, available at siamgo.app and in the app). It is not part of these terms and your consent to it is not a condition of booking beyond the data actually needed to perform the booking.
12.1. We may update these terms. For material changes we will give you at least 15 days' advance notice by email and/or push notification before the new version applies to you.
12.2. If you do not accept a change that affects an existing confirmed booking, you may cancel that booking before the change takes effect and receive a full refund of the amounts you paid to SIAMGO for it.
12.3. Each version is dated and numbered; earlier versions are available on request.
13.1. These terms are governed by the law of the Kingdom of Thailand.
13.2. Disputes may be brought in the courts of Thailand. This is non-exclusive for consumers: nothing here limits your right to sue or be sued in courts, or to rely on mandatory consumer protections, of the country where you habitually live.
13.3. We do not require consumers to arbitrate.
These terms are published in English, Russian and Thai. The English text is the reference version. [Counsel: enforceability of a language-precedence clause against consumers who transacted in Russian or Thai — consider providing that the version the consumer was shown controls in case of conflict.]
Questions, complaints and refund requests: [support email] — we aim to acknowledge within 2 business days. If you are not satisfied, you may contact the Office of the Consumer Protection Board (OCPB) or bring a consumer case in the Thai courts.
